&AI Launches Opportunities: Real-Time Patent Defence Feed

&AI, the patent litigation startup, has rolled out Opportunities, a ‘personalized, real-time feed of patent litigation filings, designed to help defence-side teams identify and pursue new business’. (See AL Quick Interview with CEO, Caleb Harris, below.)

As the US-based company explained, patent litigation teams can ‘lose thousands of non-billable hours each year to business development alone’.

‘Individual attorneys may spend 30 or more minutes every day scanning new filings and assessing relevance, and when a potential opportunity is identified, preparing the technical analysis for a pitch can take upward of 10 hours’.

In short, this is time you cannot bill to anyone and it only Hoovers up your team’s bandwidth. So, this should be a clear win-win.

So, how does it work and what does it offer now that it’s come out of closed Beta testing?

  • ‘Real-Time Feed and Notifications. Opportunities delivers patent litigation filings as quickly as five minutes after electronic filings. Users can whitelist or blacklist particular parties and exclude specific case types, such as Schedule A, Hatch-Waxman Act, or Declaratory Judgment Act cases. &AI alerts users the moment a case meets a match threshold or a specific party is named.
  • Personal and Team Match. For every opportunity, the platform evaluates your team against the instant case. Teams can quickly identify the best-fit attorney and assign the right person to pursue each matter.
  • Enriched Case Overview. Each opportunity includes a detailed summary of the case, party information, asserted patents, and accused instrumentalities with linked sources. The platform also surfaces LinkedIn connections between team members and in-house counsel at the defendant, providing a direct path to a warm introduction.
  • Patent and Party Intelligence. For each asserted patent, users can view litigation history, in which venues, and the outcomes of prior cases. For parties, the platform surfaces behavioral patterns such as settlement rates, typical case durations, and litigation posture, enabling teams to quickly assess case strength and predict how a matter may unfold.’

Why do this now? Has a tech change allowed this?

No particular tech change enabled this, but we’ve noticed lots of legal tech is at odds with the billable hour model. &AI is finding a wedge in an area that is (1) non-billable time, and (2) brings in new business. Added efficiency increases revenue.

How big a difference will this make? 

Across an IP litigation practice this can be thousands of non-billable hours per year while also improving their success odds.

This is for defence, but could it also be made to work for the other side? 

Not in this exact format, but generally yes, we are working on projects to help offensive patent litigation identify new monetization opportunities to pursue. That will come soon.
